Statement of Middlesex District Attorney Marian Ryan:

Today, the Commonwealth filed a nolle prosequi in the case of Commonwealth v. Geoffrey Wilson.  Initially, the Medical Examiner ruled this case a homicide as a result of blunt/shaking injuries to the victim’s head.  As the case proceeded, defense counsel presented new information about the family medical history that was previously unknown to both the Commonwealth and the child’s parents.  That information led Dr. Cummings at the Medical Examiner’s Office to revise his prior findings.  As a result of this newly discovered information, viewed in light of other evidence in the case,  it is now in the interests of justice to end this prosecution.  

In all our cases, as with this case, we will always review and consider new evidence brought to our attention, no matter what stage we are in the proceedings, to ensure that justice is served.
