Revere Man Found Guilty Of Being A Habitual Offender

A Revere man has been convicted of being a habitual offender, Middlesex District Attorney Marian Ryan informed the public today.

Patrick Wiswall, 41, of Revere was found guilty Friday by Middlesex Superior Court Judge Kathe Tuttman on the charge of being a habitual offender.  On Tuesday, a Middlesex Superior Court jury found him guilty of the underlying offenses of breaking and entering in the daytime to commit a felony and larceny under $250 following a 5 day trial.  Judge Tuttman sentenced the defendant to 10 years in prison on the breaking and entering while being a habitual offender charge and 1 year in jail, to run concurrent, on the larceny charge.

“This defendant has repeatedly violated the law, and has a lengthy history of engaging in violent assaults and property crimes,” District Attorney Ryan said. “In considering his history, and by charging the defendant as a habitual offender, we were able to ask the Court to hold the defendant liable for the maximum sentence permissible under the sentencing guidelines.”

On February 1, 2010, at approximately 11:00 a.m., an off-duty Medford police officer was at home when his attention was drawn to a car that appeared to be circling his neighborhood.  He observed the defendant exit the car, returning within minutes.  After the defendant left the area, the officer checked a nearby home and saw that it had been broken into.  Following the break-in, the homeowner discovered several items of jewelry were missing from the residence. 

Later that day, Revere police officers working in the area of a pawn shop, observed the defendant as he exited the pawn shop, entered a nearby building and left soon thereafter without stopping or meeting with anyone.  Inside that building, the Revere officers found items of jewelry identified as those taken from the Medford residence earlier that day.
