Pennsylvania Man Found Guilty For Malden Sexual Assault

WOBURN – Middlesex District Attorney Marian Ryan announced today that Tuan Dao, 43, of York, Pennsylvania, was found guilty in connection with a 2013 sexual assault in Malden.

Following a seven day trial, a Middlesex Superior Court jury found the defendant guilty on charges of aggravated rape, kidnapping, assault with a dangerous weapon, illegal possession of a gun and assault and battery.

Middlesex Superior Court Judge Michelle Hogan scheduled sentencing for November 12 at 10 a.m. in Woburn Superior Court.

“This case began with a terrifying incident where a woman was assaulted at gunpoint and held against her will in her own home by a co-worker,” said District Attorney Ryan. “Today’s guilty verdict holds the defendant accountable for such cruelty.”

The defendant followed the victim into the bedroom of her home on November 19, 2013 and threatened her using a pistol and a knife. While she was being held in the bedroom, the defendant sexually assaulted her and threatened to kill her.

Later, the victim was able to leave the building and reported the crime to Malden Police. When police responded to the home, they found Dao still there. He was arrested and an investigation was launched. The pistol was located in the victim’s bedroom along with a note that was later determined to have been written by the defendant.

Police then found Dao’s truck contained a gun case matching the gun that was recovered, and authorities found that he had no valid firearm license.

Further investigation revealed that he was a co-worker of the victim and, at the time of the assault, they had just returned from a work-related trip.

The prosecutor assigned to this case is Assistant District Attorney Carrie Spiros. The Victim Witness Advocate is Kristin D’Agnelli. The Paralegal is Ashley Cunningham.
