Joint Release: Two Arraigned in Connection with Alleged Lexington Shooting

LEXINGTON – Middlesex District Attorney Marian Ryan and Lexington Chief of Police Mark Corr have announced that Robert Emerton, 56, of Waltham, and John Guy 51, of Billerica, were arraigned yesterday in Concord District Court in connection with an alleged shooting that occurred on August 19 in Lexington. Emerton was charged with armed robbery, attempted murder, assault and battery with a dangerous weapon, assault with a dangerous weapon, kidnapping and discharging a firearm within 500 feet of a dwelling. Guy was charged with assault and battery with a dangerous weapon, assault and battery and conspiracy to commit a felony.

Judge Lynn Brendemuehl found both defendants to be dangerous and ordered them to be held without bail. The next scheduled hearing in this case is September 30.  

On August 19, 2019, at approximately 1:36 a.m., Lexington Police responded to a report of a disturbance on Pleasant Street in Lexington. Upon arrival authorities located several shell casings indicative of a firearm having been recently discharged. Lexington Police immediately began an investigation. Through their investigation they learned that three men driving a black Honda Accord pulled into a parking lot on Pleasant Street in the early morning hours of August 19 with the intention of purchasing approximately $300 worth of marijuana. Upon arrival in the parking lot, the three men were unable to locate the motor vehicle they intended to meet in order to conduct a drug transaction, the driver of the black Honda and one of his passengers exited his car to look around the parking lot for the individuals he intended to meet. One passenger remained in the black Honda and then drove the vehicle out of the parking lot and headed southbound on Route 2. While driving the black Honda, the second operator observed a maroon Honda Accord following him at a high rate of speed. When the second operator pulled over to allow the maroon vehicle to pass, the maroon car blocked him in. Emerton then allegedly exited the maroon Honda armed with a firearm and instructed the driver to get into passenger seat. The maroon Honda driver, allegedly identified as John Guy, then followed the black Honda back to the Pleasant Street lot.

Shortly thereafter, the first operator of the black Honda then observed two vehicles coming towards him; his vehicle and a second, maroon Honda Accord. Emerton then allegedly exited the victim’s black car armed with a firearm while John Guy exited the maroon vehicle and began physically assaulting the victim. During this time, the passenger in the black Honda then began driving the vehicle towards the two defendants in an effort to intervene and assist the victim. Emerton then allegedly fired three shots striking the vehicle. Emerton and Guy then allegedly fled the scene in maroon Honda with $300 in cash. The defendants were subsequently arrested on August 20.

These charges are allegations and the defendants are presumed innocent until proven guilty.

The prosecutor assigned to yesterday’s arraignment was Assistant District Attorney Timothy Federico.
