Assistant District Attorney - Forfeitures

The job responsibilities include:

  • Working closely with local and state police departments, [other] assistant district attorneys assigned to [prosecute criminal matters in] district and superior court, Chief of the Public Protection, Antiterrorism, Corruption & Technology Unit (PACT), and forfeiture coordinator to facilitate forfeiture of property seized by police under the narcotics forfeiture statute (MGL c.94C § 47).
  • Filing civil actions in Superior Court and representing the Commonwealth [as an A.D.A.] in Superior Court and District Court proceedings which involves managing a caseload, and being responsible for all aspects including:
    • evaluating viability of potential civil forfeiture actions;
    • drafting affidavits for local and state police drug detectives;
    • filing civil complaints in Superior Court;
    • civil discovery (including drafting and answering interrogatories and document production requests, representing police witnesses at depositions, and investigating financial history of individuals claiming seized property when appropriate);
    • civil motion practice (including the filing of default, summary judgment, and other pretrial motions with supporting memoranda and opposing such motions);
      negotiation with defense attorneys and pro se defendants;
    • litigation in civil Superior Court (including conducting the full range of trial responsibilities, e.g. witness preparation, direct and cross examination of witnesses, opening and closing statements, and admission of evidentiary exhibits); and
      aiding forfeiture coordinator in facilitating distribution of seized assets.

    The MDAO is seeking candidates who have experience in civil matters, particularly depositions and interrogatories, as well as a working knowledge of criminal law and practice. Salary: 40K’s
